This is a legal process for foreign nationals seeking protection in Canada who fear persecution in their home country (Convention Refugee) or are at risk of cruel or unusual punishment, torture, or death (Person in Need of Protection). Detention hearings are separate proceedings for those held by CBSA.
Refugee claims can take 18 to 36 months from submission to the final RPD decision. Detention hearings are expedited, generally occurring within 48 hours of detention.
